Judge rules in favor of CNN’s Jim Acosta, restores press pass

They’re using a tweet and a fundraising email.

A federal judge ruled in favor of CNN reporter Jim Acosta in his spat with the White House, restoring his press pass.

In the ruling, Judge Timothy Kelly questioned if decision caused irreparable harm to Acosta’s reputation and whether he was afforded due process.

CNN sued the White House for its decision to revoke reporter Jim Acosta’s press pass last week. In its lawsuit, CNN named as evidence a tweet from President Trump from May 9, as well as a Nov. 14 fundraising email.

“The Fake News is working overtime. Just reported that, despite the tremendous success we are having with the economy & all things else, 91% of the Network News about me is negative (Fake). Why do we work so hard in working with the media when it is corrupt? Take away credentials?”

NBC reporter Jason Abbruzzese tweeted a document that appears to be an exhibit list from the suit.

The lawsuit also cited a fundraising email from Nov. 14, in which the president’s fundraising team told supporters,

“CNN is SUING President Trump, Sarah Huckabee Sanders, a Secret Service agent, and other White House officials……All because they REVOKED Jim Acosta’s press badge after his continuous grandstanding and inappropriate refusal to yield to other reporters. President Trump will NOT put up with the media’s liberal bias and utter disrespect for this Administration and the hardworking Americans who stand with us. But the President wants to know what *YOU* think.”

The email includes a “media accountability survey,” which asks supporters if they think the White House was correct in revoking Acosta’s press pass.  

Acosta’s press pass was initially revoked after he sparred with Trump during a Q&A, refusing to relinquish a microphone even when a White House aide intervened.
